Who Can Be Held Liable in a Bus Accident

Responsibility in a bus accident rarely falls on just one party. Depending on the circumstances, liable parties can include the bus driver, the company or transit agency operating the vehicle, a parts or vehicle manufacturer if a mechanical defect contributed to the crash, government entities responsible for road conditions, or another driver whose negligence caused the collision.

The legal framework governing your claim depends on who operated the bus. When a government agency like B-Line runs the route, California’s Government Claims Act applies and imposes a compressed filing timeline. Private charter buses, tour operators, and interstate carriers fall under standard California tort law and federal motor carrier safety regulations enforced by the Federal Motor Carrier Safety Administration. Identifying the correct framework is one of the first things we do after a crash, and it can’t wait.

Common Causes of Bus Crashes on Chico Roadways

Driver error accounts for a significant share of bus accidents: distracted driving, impairment, speeding, and inadequate training all create dangerous situations. Fatigue is a particular concern. California Vehicle Code section 21702 prohibits bus drivers from operating more than 10 consecutive hours or more than 10 hours within a 15-hour window, and violations of that rule can support a negligence claim.

Mechanical failures, including brake problems and tire blowouts, also cause crashes. Because of their size and weight, buses amplify the consequences of any failure. On major corridors where B-Line routes run through Chico, a single incident can involve multiple vehicles and multiple injury victims.

The Highest Standard of Care Under California Law

California classifies buses as common carriers because they transport paying passengers for a fee. Under California Civil Code section 2100, common carriers must exercise the utmost care toward their passengers. That standard is stricter than the ordinary reasonable care a private driver owes others on the road.

In practical terms, even minor lapses in driver attention or bus maintenance can constitute actionable negligence. The duty extends to drivers, maintenance crews, and the operating company or agency. Pedestrians, cyclists, and other vehicle occupants struck by a bus aren’t covered by the common carrier standard, but they retain the right to bring negligence claims against the driver and operator.

Government Bus Claims & the Six-Month Deadline

When B-Line or another public entity operates the bus, the California Government Claims Act requires a written tort claim to be filed with the responsible agency within six months of the accident date under Government Code section 911.2. That deadline is significantly shorter than the two-year statute of limitations that applies to private carriers, and missing it may bar an injured person from recovering compensation regardless of how serious the injuries are.

Filing with the wrong agency may carry the same consequence, treated as if no claim was filed at all. After the agency receives the claim, it has 45 days to respond. A written rejection gives the injured person six months from that notice to file a civil lawsuit. If the agency doesn’t formally respond within 45 days, the claim is deemed rejected by operation of law, and the deadline to file suit depends on whether a written rejection notice is later served. Acting promptly and with an attorney’s guidance is an important way to protect these rights.

Compensation Available to Bus Accident Victims in California

Injured victims may be entitled to two categories of damages depending on the circumstances of their case.

Economic Damages

Economic damages cover current and future medical expenses, hospital bills, rehabilitation and physical therapy costs, lost wages, and reduced earning capacity. These losses are tied to documented financial harm caused by the accident.

Non-Economic & Wrongful Death Damages

Non-economic damages can include compensation for pain and suffering, emotional distress, and loss of enjoyment of life. In cases involving a fatality, surviving family members may have a wrongful death claim.

Bus companies and transit agencies typically carry substantial insurance policies, but insurers work to minimize payouts. The value of any claim depends on the severity of the injuries, the financial losses documented, and the strength of the evidence preserved after the accident. Having an attorney manage negotiations with the insurer matters when pursuing compensation supported by the circumstances.
